Competition Rules
"Parabaya x Le Bon Marché"
Article 1: The Organizer
The company Parabaya, whose head office is located at 270, avenue des Bigochets 78670 Villennes sur Seine, is organizing a game with an obligation to purchase, without a minimum amount, entitled “La grand Tombola de Parabaya” (hereinafter referred to as the “Game”) in the Accessoire Horlogerie Joaillerie space on the ground floor of Le Bon Marché (24 Rue de Sèvres, 75007 Paris).
We invite you to carefully read these rules which govern your participation in the Game. By participating in the Game, you unreservedly accept these rules.
Article 2: Duration
The Game will take place from December 7, 2024 at 10 a.m. to December 15, 2024 at 7 p.m., according to the terms described in these rules.
It is understood that Parabaya may postpone or cancel the Game if circumstances require it. In this case, participants will be informed as soon as possible by email.
Article 3: Participants
The Game is open to any natural person, adult or minor, who has obtained prior authorization from their legal representatives, residing in mainland France and Corsica (excluding DOM-TOM), (hereinafter referred to as the “Participant”).
Participation is limited to once during the entire duration of the Game.
Participation is strictly nominative and the Participant may not under any circumstances play under several pseudonyms, with several email addresses, regardless of the number of email addresses he/she has or on behalf of other participants.
Persons directly or indirectly involved in the organisation, production, implementation, promotion and running of the Game may not participate. Therefore, Parabaya's corporate officers and staff members (managers, employees, directors and permanent and occasional employees, whether salaried or not) are excluded.
Each participant acknowledges that the data he/she communicates to Parabaya for the purposes of his/her participation in the Game are accurate and constitute proof of identity. Parabaya reserves the right to ask any participant to provide proof of these conditions. Any person who does not meet these conditions or refuses to provide proof of them will be excluded from the Game and will not be able to benefit from the prize in the event of a win.
Article 4: Terms of participation
To participate in the Game, the Customer must, between December 7, 2024 at 10 a.m. and December 15, 2024 at 7 p.m., complete the Parabaya form
On this occasion, the participant must complete the Game participation form, by completing the following mandatory fields indicated by an asterisk, after having read and accepted the content of these rules:
- Name
- First name
- Phone number
- E-mail address
Only one entry per person is allowed. If multiple entries are made, the entry will be automatically canceled.
The express, voluntary and unreserved acceptance of these Game rules will be deemed to have been given by the Participant as soon as he has validated his participation on the Site, as described in this article.
The Participant is responsible for the accuracy of the information he has communicated, and for any changes that may occur.
Article 5: Designation of Winners
The Game will close on December 15, 2024 at 11:59 p.m. Paris time (France).
Only participations validated before the participation deadline date and time will be taken into account, it being specified that only the time of the Parabaya computer system is authentic.
A draw will be held on December 15 at 7 p.m. to designate the 5 winners.
The winner will be personally notified of his or her winnings by email within a few days of the draw, which he or she must acknowledge receipt of to notify his or her acceptance of said winnings by return email within five (5) days.
It is the Winner's responsibility to ensure that their email address and telephone number are valid.
If the winner cannot be contacted or does not respond within five (5) days from the day Parabaya attempts to contact him/her, Parabaya reserves the right to select an alternate winner.
Article 6: endowments
Each winner will receive a Pipoca Parabaya bracelet worth €35.
Each lot is non-exchangeable and non-refundable.
It should be noted that Le Bon Marché cannot be held liable in connection with the delivery and use of the lot by Parabaya.
Any possible complaints must be addressed directly to Parabaya, which will be exclusively responsible for them.
Article 7: Award of grants
The winner will be informed by email or telephone and must come to Bon Marché at the Parabaya area to collect their prize.
The prizes are nominative and cannot give rise to any dispute of any kind, nor to the delivery of their cash equivalent (total or partial), nor to their exchange or replacement for another prize, of whatever value, for whatever reason.
If circumstances require it, Parabaya reserves the right to substitute, at any time, the proposed prize with a prize of equivalent value or similar characteristics, without this giving rise to any compensation or indemnity of any kind.
Le Bon Marché will not be required to award prizes if the winner has not complied with these rules.
Parabaya cannot be held responsible in the event of non-delivery of the email or call announcing the win due to an error in the telephone number indicated by the participant on their Game participation form, in the event of a failure of the access provider, in the event of a failure of the internet network or for any other case.
Article 8: Liability
Le Bon Marché cannot be held liable in the event of force majeure, events beyond its control or justified necessity if this game should be shortened, extended, postponed, modified or cancelled.
Le Bon Marché cannot be held responsible for any event that is not attributable to it, in particular in the event of malfunction of the computer lines, technical failure making it impossible to continue the Game, any technical, hardware or software failures of any nature whatsoever that have prevented or limited the possibility of participating in the Game or that have damaged a participant's system.
Only Parabaya can be held liable in connection with this game.
Parabaya reserves the right to exclude from the Game any person who disrupts its smooth running.
Article 9: Protection of personal data
As part of your participation in the competition, we collect certain personal data necessary for the management of the game and the draw. This data is subject to strict rules of use and protection, in accordance with the "Data Protection" law of January 6, 1978, as amended.
The data collected will be used exclusively for:
- Administrative management of the competition;
- Verification of participant eligibility;
- Carrying out the draw and contacting the winners.
The data collected will not be subject to any automated or computer processing for commercial or promotional purposes. No information or commercial offers will be sent to participants.
The data will be kept only for the duration necessary for the organization and management of the competition. They will be deleted immediately after the end of the competition and the awarding of prizes, unless otherwise required by law.
The data collected is strictly confidential and will only be accessible to persons authorized to manage the competition. No transmission or transfer of data to third parties will take place.
In accordance with current legislation, participants have the right to access, rectify, delete or oppose their personal data. These rights can be exercised at any time by contacting the following email address: contact@parabaya.com.
Article 10: Regulations and Applicable Law
Participation in this Game implies full and unreserved acceptance of these complete rules.
The law applicable to this Game is French law.
Article 11: Consultation of the Regulations
These rules can be consulted on the Parabaya website www.parabaya.com throughout the duration of the Game.
